Notary Services
Notaries in India perform a public function, authorised under the Notaries Act, 1952. By certifying and attesting documents, a notary public lends credence to those documents so that they may be accepted, where relevant, in other jurisdictions.
How we can help you
If you need to sign a document or attest facts for use in a foreign country, the receiving authority will want assurance that the contents are accurate and that signatures are by authorised persons. A Notary Public is empowered to provide that guarantee.
Clients are often asked by their foreign counterparts or legal advisers to send documents “notarised” or “attested” by a notary.
In our firm, certain staff members are qualified Notaries Public. When they act in their capacity as notaries, they do so independently, and the notarial services are offered directly to you.
What Does the Notary Do?
A Notary Public in India may undertake the following:
- Witness a person signing a document
- Verify or attest that copies are true copies of original documents
- Administer oath or declaration
Before notarising, the notary must satisfy themselves that:
- The person understands the nature and effect of the document
- The person presenting identification is indeed who they claim to be
- If signing on behalf of a company, that the person has proper authority
If the document is destined for use abroad, the notary may advise on whether additional steps, such as consular attestation or apostille (if the destination country is a party to the Hague Convention) will be needed.
